2. General terms and conditions
The general conditions of the online store operation define the conditions of sales and purchases of products available in the online store, as well as the rights and obligations of the provider and the buyer.
The buyer agrees to the general terms and conditions valid at the time of purchase or submitting an online order.
These Terms are constructed in accordance with the various laws of the Company's registered office jurisdiction, including but not limited to:

The buyer acknowledges and accepts these conditions when submitting and confirming the order and undertakes to adhere to all terms and conditions and the privacy policy.
All users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission and direct supervision of their parents or guardians to use the Services. If you are a minor, you must ask your parent or guardian to read and agree to these legal terms before continuing to use the services on the website.
By agreeing to the Company's General Terms and Conditions policy, you also consent to periodically receiving promotional materials and newsletters from the company. If you choose to unsubscribe from the company's newsletter, please send us an email with your request to: shop@vivalagaia.com.
The company reserves the right to change the General Terms and Conditions at any time (without special notice) and publish them on the store's website.
3. Products and prices
All products are subject to availability.
We reserve the right to discontinue the production and/or sale of any products at any time, for any reason.
All prices (for all products) online are subject to change.
The published prices for the purchase of products are valid only for purchases in the online store.
The prices of the products displayed in the online store are in euros and include value added tax (VAT).
The buyer pays for the goods at the prices in effect on the day the order was placed and when the company sends the customer an e-mail confirming the order.
Prices do not include postage and packaging costs, unless expressly stated otherwise.
Product prices are subject to change without notice.
Postage/Shipment price is based on GLS services and is calculated based on order/shopping cart amount and/or customers shipment address and is calculated during checkout process.
When paying cash on delivery, you will be charged additional fee of EUR 1.49 for each order, regardless of the purchasing amount.
Discounts and Promotional Codes
In the online store, products that are sold at a reduced price are specially marked.
The use of promotional codes is subject to special conditions, which are determined when the promotional code is published.
Promotional codes may not be used in combination with other discounts or promotional codes, unless expressly stated otherwise.
Price errors
If an error occurs in the price of the product, the company undertakes to contact the customer and offer the correct price.
The buyer can choose whether to buy the product at the correct price or cancel the purchase free of charge.
4. Ordering and paying
Payment for the ordered goods is made in advance according to the proforma invoice, unless explicitly stated otherwise.
The goods are shipped after receiving payment to the company's account.
We accept the following payment methods:

• Mastercard
• Maestro
Payment service providers are responsible for protecting personal data and payment information.
The company uses appropriate technical and organizational means to ensure the security and confidentiality of personal data and payment information for all other aspects in accordance with the GDPR and the Personal Data Protection Act.
By submitting an order, the customer agrees to provide current, complete and accurate purchase and account information for all purchases made through the online store. Further, the customer agrees to update their account and payment information, including email address, payment method and payment card expiration date, in a timely manner so that we can complete transactions and contact you as needed.
All payments must be made in Euros.
After successful payment, the company will send the customer an invoice for the ordered goods or services in the form of a PDF document to the provided e-mail address and subsequently in physical form together with the package to the address that the customer specified when placing the order via the company's online store.
The buyer has the duty to review all the information and specifications of the order before executing/confirming the order. Any objections regarding irregularities in the issued invoices, submitted later, will not be taken into account.
The Company reserves the right to refuse any order placed via the online store.
The Company reserves the right to limit or cancel the quantity purchased per person, household or order. This limitation may include orders placed by the same buyer, same payment method, and/or orders using the same billing or shipping address.

5. Delivery and pick-up
Products will be delivered to the address specified at the time of purchase and order submission.
Delivery is carried out exclusively by the GLS courier service. The products are packed in delivery boxes so that the products are not lost and/or damaged during transport.
- Delivery for orders over 30 EUR is free for the area of Slovenia. For orders below 30 EUR, delivery fee is charged 4 EUR.
- Delivery for orders over 100 EUR is free for the area of Croatia. For orders below 100 EUR, delivery fee is charged 10 EUR.
- Delivery for orders over 100 EUR is free for the area of Austria, Belgium, Germany, Luxembourg, Netherlands. For orders below 100 EUR, delivery fee is charged 15 EUR.
- Delivery for orders over 100 EUR is free for the area of Denmark, Italy. For orders below 100 EUR, delivery fee is charged 16 EUR.
- Delivery for orders over 100 EUR is free for the area of Czech Republic, France, Hungary, Lithuania, Monaco, Poland, Slovakia, United Kingdom. For orders below 100 EUR, delivery fee is charged 15 EUR.
Orders placed by 12 noon on a business day will be shipped within 1-3 business days.
Delivery of packages within Slovenia between 08:00 and 17:00 on the next business day after pick-up
Before taking over the shipment, the buyer is obliged to inspect it for any external damage. If external damage is visible, the buyer must refuse to accept the shipment or report it to the person who delivered the shipment.
Upon receipt of the goods, please check the correctness of the order and, in case of missing goods, notify the delivery person immediately. When taking over the goods, the buyer must sign the delivery note or the delivery note, which the courier service uses as confirmation of the takeover.
If the customer receives a package with different products than what he ordered, he has the right to have the correct products delivered. In the event that this is not possible, the buyer is entitled to a refund of the purchase price, shipping costs and return costs of the products, and is obliged to return the wrongly delivered products.
In the event of a delivery delay, the company will notify the customer on submitted e-mail and agree on a new delivery date.
If an agreement cannot be reached, the buyer has the right to cancel the order.
Upon receiving the product, the buyer receives all the documents that accompany the product, such as the invoice and delivery receipt, which he must sign.
The signature of the delivery receipt means that the product has been received without visible external damage.
The goods are insured against loss during delivery, but the company is not responsible for delays or damage to the products during delivery.
In case of force majeure, in accordance with Article 153 of the Code of Obligations, the company is not responsible for late or non-delivery of goods.

6. Returns and Refunds
The buyer may unilaterally withdraw from the contract without giving a reason within 14 days of receipt of the goods in accordance with paragraph 1 of Article 43.č. of the Consumer Protection Act, except in the case when the service has already been completed in its entirety.
The buyer has the right to return goods in case of delivery of goods that were not ordered, or delivery of goods with a defect or damage that did not occur during transport.
If the consumer causes a decrease in the value of the goods due to conduct that is not absolutely necessary to determine the nature, properties and functioning of the goods, he is responsible for this decrease in value in accordance with paragraph 9 of Article 43.d. of the Consumer Protection Act.
The returned product must be in the original packaging with the declaration and accompanying contents, including the invoice and other accompanying contents that were sent together with the goods.
The company Arhel d.o.o. may determine the terms of the return of the goods and the percentage of the reduction of the amount of the refund to the customer due to the reduction in the value of the product.
Please note that we do not accept shipments with a payment to our address.
The buyer bears the cost of returning the goods.
In the event of a justified hidden defect that you discover after opening the product, you can unilaterally terminate the contract and request a refund, product replacement, defect correction, or price reduction.
7. Complaints
Complaints about products and/or services are handled in accordance with the Consumer Protection Act.
If the buyer has any complaint and/or claim, he can contact us via e-mail at shop@vivalagaia.si and/or in writing at the address: Arhel d.o.o., Pod lipami 35, 1218 Žeje pri Komenda or by phone at +386 59 033 386 (during working hours from 08:00-16:00 on Monday - Friday).
In the event of a complaint, please notify us as soon as possible or within two working days after receiving the shipment.
For faster processing of the complaint, please provide us with the order number, invoice number and your contact information (name, surname, e-mail address, phone).
Upon receipt of a written complaint, we will confirm its receipt without delay and respond to it no later than 15 days from the date of receipt.
In case of a justified complaint, we offer you the option of canceling the contract with a refund or replacement of the product.
The company covers the costs of replacing the product in case of a justified complaint.
8. Limitation of liability
The company is not responsible for any possible damage that may occur as a result of using the online store, its products or purchased products on it.
The company does not assume responsibility for any direct, indirect, incidental or consequential damage, including possible loss of profit or any other damage/loss related to the use of services and/or products purchased through the online store and/or the use of data or information obtained on the website.
The company reserves the right to exceptionally withdraw from the execution of the order in cases where the ordered products are no longer in stock, if an increased financial risk of the buyer is identified or if there is an obvious error in the price of the products.
In such and similar cases, the buyer will be immediately informed of a possible withdrawal from the contract by the company. In addition, the company reserves the right to withdraw from the contract in the event of a material error in accordance with Article 46 of the Code of Obligations.
9. Intellectual property:
All content on the online store (https://www.vivalagaia.com), including text, graphics, logos, images and software, is owned by the online store or our licensors and is protected by copyright and other intellectual property rights.
The content of the online store may not be used, reproduced or modified without the express written consent of the Company.
10. Applicable law and resolution of disputes and complaints
All sales conditions and contracts concluded between the company and the customer are governed exclusively by the law of the Republic of Slovenia.
The contracting parties undertake to resolve all potential disputes in a peaceful manner.
If out-of-court methods are not successful, the local court in the Republic of Slovenia, where the company's headquarters are located, is responsible for resolving the dispute.
The company does not recognize any provider of out-of-court resolution of consumer disputes as competent to resolve a consumer dispute in accordance with the Act on out-of-court resolution of consumer disputes.
The company complies with consumer protection laws and provides an effective and confidential complaint handling system.
If the buyer wants to file a complaint, he can send it to the email address shop@vivalagaia.com.
The company will confirm receipt of the complaint to the buyer within fifteen working days and inform him of the progress and duration of the complaint procedure.

This arrangement is derived from the Out-of-Court Consumer Dispute Resolution Act, Regulation (EU) No. 524/2013 of the European Parliament and the Council on online resolution of consumer disputes and amendments to Regulation (EC) no. 2016/2004 and Directive 2009/22/EC.
11. Changes to the terms and conditions
The Company reserves the right to change or update these terms and conditions without prior notice.
By using our online store, you agree to be bound by the latest version of these terms and conditions. In addition, by using our online store, you agree to these terms and conditions and all applicable laws and regulations.
